Terms of Use for DB Fernverkehr AG Websites and Apps

The operator of these websites/apps is DB Fernverkehr AG, Europa-Allee 78-84, 60486 Frankfurt, Germany.

DB Fernverkehr AG is solely responsible for the content of its applications that are published via the direct channels of Deutsche Bahn in the app stores (currently Google Play Store, AppStore, AppGallery). 

The content of these websites/apps is created with the greatest possible care. However, DB Fernverkehr AG assumes no liability for the accuracy, completeness and up-to-dateness of the available content.

DB Fernverkehr AG will endeavour to provide the websites/apps and their functions with as little interruption as possible. Downtimes cannot be ruled out, however. DB Fernverkehr AG reserves the right to change or discontinue its offer at any time. DB Fernverkehr AG accepts no liability for interruptions or other disruptions. 

The websites/apps may be used for the following purposes only:

(1.) accessing and displaying the websites/apps and the information, maps and other content made available there, in particular for checking information on arrival and departure times and mobility services,

(2.) performing lawful bookings and reservations, and

(3.) using other functions made available on the websites/in the apps.

Any other use of the websites/apps without the prior written consent of DB Fernverkehr AG is prohibited.

The reproduction, processing, dissemination, public display or any other form of use of the websites'/apps' content for commercial purposes is not permitted. Similarly, the use of automated systems or automated software for extracting the websites'/apps' content is not permitted. Furthermore, accessing the content of these websites/apps via any means other than the websites'/apps' user interface is not permitted.

No actions may be undertaken that could have a disruptive impact on the functioning of the websites/apps. Such actions also include those which could result in an excessive or unreasonable load on the websites/apps and/or on the infrastructure behind them.

Regardless of the assertion of other rights, DB Fernverkehr AG reserves the right to suspend access to its websites/apps at any time if a party contravenes these Terms of Use. 

All copyrights, in particular rights pertaining to databases, brands, registered designs and other rights which protect intellectual property (including the structure and visuals of the website), are retained by DB Fernverkehr AG, its licensors or third-party providers. Reproducing, processing, disseminating, publicly displaying or making any other use of the content of the websites/apps or the underlying software code, either in part or in full, is not permitted without the owner's prior written approval. 

DB Fernverkehr AG shall be liable in accordance with the statutory provisions if damage is caused by an intentional or grossly negligent breach of duty by DB Fernverkehr AG or its legal representatives or performing agents.

DB Fernverkehr AG shall also be liable without limitation for damages resulting from injury to life, limb or health, for characteristics that represent a contractually guaranteed quality and for fraudulently concealed defects. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

DB Fernverkehr AG shall be liable for slightly negligent breaches of cardinal contractual obligations. Cardinal obligations are those

(i) whose breach would jeopardise the achievement of the contract's purpose,

(ii) which enable the performance or fulfilment of the contract and which the other party routinely relies on being met. In such cases, DB Fernverkehr AG shall only be liable for typically foreseeable damages. DB Fernverkehr AG shall not be held liable for slightly negligent breaches of obligations other than those described above.

Insofar as liability is excluded or limited, this exclusion or limitation shall also apply to employees, legal representatives or performing agents.

The websites/apps may contain links to third-party websites/apps. DB Fernverkehr AG checks this third-party content when links are first set to assess if it could potentially result in a civil or criminal legal action. However, the company does not continuously monitor all content for changes. DB Fernverkehr AG therefore assumes no liability for the content of third-party websites/apps, nor does it endorse or adopt such websites/apps and their content as its own. The company deletes links if it ascertains or is informed that the specific content to which it has linked could potentially result in civil or criminal legal action.

In DB Navigator, you will find information on open source and commercial software, including the necessary references, licence conditions and notes under "Legal notice, Licences" in the "Profile" tab. 

The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer domiciled outside the Federal Republic of Germany, the law of the country in which you are domiciled may also apply in the case of legally mandatory provisions.
